This course is going to take place at the Institute for Italian Studies, not at the Law Department!

Course Description

Il corso si propone di approfondire il quadro giuridico internazionale che regola i conflitti armati, con particolare riferimento alla disciplina dell’uso della forza, al diritto internazionale umanitario ed ai diritti umani. La prima parte del corso sarà dedicata allo studio delle norme che regolano l’uso della forza nei rapporti tra Stati: il divieto dell’uso della forza, la legittima difesa ed il sistema di sicurezza collettivo delle Nazioni Unite. La seconda parte delle lezioni si concerterà sull’analisi delle regole che disciplinano la condotta delle ostilità, evidenziando le difficoltà poste dai conflitti armati non internazionali e dall’emergere degli attori non-statali. Infine, la terza parte del corso sarà dedicata all’approfondimento di alcune questioni attuali del diritto dei conflitti armati, quali l’impiego di droni e armi autonome, la guerra ciberneticae la proliferazione nucleare.

Le lezioni frontali verranno affiancate dall’analisi dei trattati internazionali rilevanti, della giurisprudenza della Corte Internazionale di Giustizia e della Corte Europea dei Diritti dell’Uomo, nonché dallo studio dei passi selezionati dai libri di testo suggeriti.
